GENESEO — Three individuals are facing drug related charges after a traffic stop on Interstate 390 yielded a large quantity of crack.
On Feb. 18, Livingston County Deputy Shawn Whitford was assigned to the Sheriff’s Office Operation Safe Interstate initiative when he stopped a vehicle on Interstate 390 for a violation of the NYS Vehicle and Traffic Law.
During the stop, the deputy made contact with the operator of the vehicle, he allegedly smelled the odor of marijuana from inside the vehicle, initiating a roadside drug investigation.
It is alleged that during the course of the investigation, a passenger in the vehicle, Ruben R. Smith, 29, of Rochester was allegedly in possession of five packages of marijuana that he attempted to hide in the seat of the vehicle. Smith was arrested and charged with unlawful possession of marijuana and felony tampering with physical evidence.
It is also alleged that another passenger in the vehicle, Dakota J. Costello, 27, of Bath was allegedly in possession of two bags of crack cocaine, along with a smoking device. Costello was arrested and charged with seventh-degree criminal possession of a controlled substance and second-degree criminal use of drug paraphernalia.
It is further alleged that a third passenger in the vehicle, Anthony T. Smith, 38, of Rochester was in possession of 70 bags of crack cocaine, weighing approximately 37 grams along with unused drug packaging, razor blades, and a digital scale. It is alleged that Smith also attempted to hide the items when the vehicle was being pulled over. Smith was arrested and charged with two counts of felony third-degree criminal possession of a controlled substance, felony tampering with physical evidence, and two counts of second-degree criminal use of drug paraphernalia.
Smith, Costello, and Smith were turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention. It was advised that both Ruben Smith and Anthony Smith be held without the chance of bail due to having multiple prior felony convictions per the NYS Criminal Procedure Law.
Ruben Smith, Dakota Costello, and Anthony Smith were later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Groveland Justice Jeanean Love. The Judge remanded Ruben Smith and Anthony Smith to the custody of the Sheriff with the chance of bail pending further court action. Dakota Costello was remanded to the custody of the Sheriff on $500 cash bail or $1,000 bond.
