Amish man in Wayland court over alleged code violations

An Amish man, a local homeowner and his parents appeared in Wayland Town Court over alleged code enforcement violations last month.

The Amish man, Enos Mast of Cooperstown, formerly of Jasper, does not carry workers compensation and liability insurance, both of which are required for a roofing permit.

Mast began working on a barn roof belonging to Martin “Chip” Kimmel V on Ivy Lea Drive in Wayland after the permit was denied by code enforcement officer Robert Bourgoine. A stop work order was placed by Burgoine on July 21.

On July 29, Bourgoine issued Mast, Kimmel and  his mother and father Marty IV and Carol Kimmel appearance tickets on three violations – failing to obtain a building permit; not having workers compensation and liability insurance; and ignoring a stop work order.

On Sept. 15, the alleged violators appeared before Justice Kerry Pebbles in Town of Wayland Court  for arraignment.

All parties plead not guilty. Martin IV contended that he and his wife Carol do not live on nor own the property.

Justice Pebbles, David Coddington, attorney representing the defendants and Rachel Scura, attorney representing the Town of Wayland, will meet during the regular Town Court session on Oct. 20 to seek an agreement on the matter.

If no solution is agreed upon at that time, a trial date will be scheduled.

Due to Mast’s difficulty in obtaining transportation from Cooperstown, his October appearance has been waived.
