Joseph Volta faces additional charges in sex abuse case

A Steuben County Jail inmate faces additional charges in a sex abuse case that landed him in jail on Dec. 6. Joseph Volta III, 36, of Dansville now faces one count of first-degree criminal contempt, a class E felony, on top of original charges of first-degree criminal sex act, a class B felony and endangering the welfare of a child, a class A misdemeanor.

Sheriff’s Office investigators claim Volta made some 10 collect phone calls to the victim’s family, despite an order of protection issued on the date of his arrest.

After arraignment, he was remanded back to the county jail and will appear in Bath town court on Dec. 19.

Joseph Volta’s original charges stem from allegations he had anal sexual contact with a minor child who was in his care at his Dansville residence in May. He fled from his home on Dec. 5, telling his wife, Kimberly Volta, he would not go back to jail, but returned home the following day, when he was arrested.

A class E felony carries a penalty of up to four years in prison. A class B felony can result in up to 25 years in prison. Class A misdemeanors can be punished with up to one year in jail or three years probation along with a fine up to $1,000.

An unnamed 15-year-old male was also arrested in the case on allegations he has sexual contact with a 10-year-old female.

Kimberly Volta was arrested last week and charged with three counts of endangering the welfare of a child.
